Here’s what to do if you suspect an early approval:🔑 Visa Availability: The Core of Approval ValidityFor an I-485 adjustment to be valid, a visa number must be available at the time of approval. USCIS uses the Visa Bulletin from the Department of State to confirm availability, based on the Final Action dates. A visa number is allocated only during final adjudication, not at earlier stages like filing or interviews.🔍 How to Confirm If Your I-485 Was Approved in ErrorCheck the Visa Bulletin: Look at the Final Action Date in the bulletin for the month your I-485 was approved.Compare Priority Dates: If your I-140 priority date isn’t earlier than the cutoff date, your approval may be premature.⚠️ Consequences of Erroneous ApprovalGreen Card Rescission: USCIS can issue a Notice of Intent to Rescind (NOIR) within five years of approval. If this happens, you may lose your U.S. residency.Naturalization Issues: When applying for U.S. citizenship, you must prove that your green card was lawfully issued. If USCIS finds the approval was a mistake, your naturalization could be denied, and your permanent resident status revoked.🛠️ Steps to Correct an Erroneous ApprovalContact USCIS: Reach out immediately to request that your case be reopened. USCIS just extended the validity of renewed Green Cards from 24 to 36 months. Here's what you need to know. Context: On September 10, 2024, USCIS increased the validity period for Green Card renewals using Form I-90. This extension primarily targets Green Card holders renewing their 10-year cards, including employment-based immigrants, family-sponsored individuals, and long-term residents. It's especially impactful for those from countries with high application rates like India and China, who often face longer processing times due to per-country visa limits and significant backlogs.✅ Key updates:1. 36-month validity for Form I-90 receipt notices (up from 24 months)2. Applies to renewals of expiring or expired Green Cards3. Receipt notice + expired card = proof of legal status and work authorization💡 Who should renew or replace? People with - 10-year cards- Conditional cards (36 months)- Cards without expiration date- Lost, stolen, or damaged cards- If you became a permanent resident before age 14But the bigger picture is daunting. 34.7 million Green Card applications are in the pipeline for 2024. Only about 3% are likely to be approved this year. Over 1 million Indians face decades-long queues. As of 2022, 12.9 million Green Card holders lived in the US. 9.2 million were eligible for citizenship. In the top three employment-based categories, 1.2 million Indians are waiting. Some Quick FAQs About NIWs and EB-1AsI often encounter the same or similar questions from clients. Below is a list of common questions that I receive about NIWs and EB-1As. Can you apply for an NIW and EB-1A While Abroad?You can apply for an NIW and EB-1 anywhere in the world, and the case can be adjudicated while you are either inside or outside the United States. Your physical location has almost no effect on the merits-based portion of the case.Can you apply for an NIW and have another status in the U.S.?Yes, you can have multiple I-140 petitions pending at the same time. For instance, you may have an EB-1A and an NIW pending while being on an O-1 visa. There is no conflict. However, you should not have more than one merits-based case in the same category, so you should not have two NIW cases at the same time. But you can have a PERM case sponsored by your employer while you have an NIW case petitioned by yourself.Are letters of support required?No, letters of support are not required; however, in practice, they are effective forms of evidence to frame the case.What is the right number and mixture of letters?I advise clients to submit cases with 4-7 letters of support from some supporters who know you and have worked with you professionally, while others may be familiar with your work but may not know you personally.What is the right length for the letters of support?1-2 pages - keep it clear and succinct.Is it better to have your EB-1A or NIW sponsored by a company?No, I usually think it is a detriment to the case, even if the company pays for the petition. These two categories are self-sponsored, hence they really should be about the individual in the case.If you have an O-1, does it mean that you are likely to get an EB-1A or NIW approved?Recently, the EB-1A guidance in the updated USCIS policy manual addressed having an O-1 by saying, "Though the prior approval of an O-1 petition is a relevant consideration...., it is not determinative." Having an O-1 is a pretty good indication of approvability for self-sponsored green cards.Personal Opinion on O-1 Visa ApprovalsI personally think having an O-1 approved is a better indication for NIWs than for EB-1As. O-1s are often harder to obtain than NIWs as they have set evidentiary criteria just like EB-1A, while NIWs are more free-wheeling. I have had the experience of getting an O-1 denied while getting the client a NIW approved. In practice service is harsher on EB-1As than on O-1As.Let’s discuss!
